No lawyer will take your case if (APS) Adult Protective Services is involved. Evidently APS has so much power that the judges just rubber stamp anything they ask and no lawyer will go against.
I have a lot of people trying to take what is rightfully mine. I have an experienced real estate person that has been known to do mortgage fraud and lawyer against me. I feel I can’t get fair treatment.
This is my story and I don’t want it to happen to more people.
My common law husband, Ed Lenca died suddenly last January 28, 2023 right after APS got a reverse mortgage without my knowledge on our property.
If any of you people have had dealings with these people please let me know as I am fighting them in court. The judge seems to just rubber stamp anything APS gives him and doesn’t seem to rule on anything very quickly as it took 2 months to get rid of my bad attorney. It isn’t fair to people when time is of the essence and they have to represent themselves.
Our local Realtor, Keith Hurtubise, we thought was a friend to Ed and me. I had asked him to help me with Ed as during Covid he had started drinking too much and was becoming abusive. Keith interceded for me with Ed. However, instead of helping, a woman he previously knew, called APS to check on Ed and blame me for his drinking so that I could not advocate for him. Once APS is involved, they isolate the person so no one can advocate for them. I have been told by lawyers, that no one will take your case against APS unless you are a millionaire as APS is too powerful.
It took Diane Head, the original APS investigator, 3 tries visiting Ed before they caught him drunk and started to take over. It is just like the movie on Netflix “I care a lot” and the documentary on Prime, “The Guardians: by Billie Mintz. It is important to see these otherwise you would not understand what is happening. I couldn’t believe it myself going through it. So confusing. This is a warning to people who drink as you can be considered incompetent.
They quickly deemed Ed incompetent and locked up our joint checking account. Finding this out and being threatened by Diane Head, I tried to step away and let Keith check on him not knowing that Keith was in cahoots with the APS people.
Sept 4, 2020, Ed finding out that they had attached to our money and that he was already under their care, he finally had the motivation to quit drinking. While knowing this, APS did not give him any medication to help him with alcohol withdrawal. I recorded him sober talking about it and asking to be taken out of their care. He was fine and sober until Sept 15, 2020. I had come home to get something but found him clearly insane as he didn’t even recognize me and started threatening me. I hid in the barn and called my son who helped me get a restraining order due to his threatening behavior. I reported this to the VA.
The VA thought he might have had a stroke so they asked for him to be taken the next morning to the VA ER and they kept him until Sept 28. 2020. The VA psychologist, knowing that APS had filed a case against me, warned me to stay away and that they were coming after me. So I moved out from the house and put the house in Ed’s name (thinking this might satisfy them so they would leave me alone and stop threatening me), and relinquished my POA on him and took myself off the checkbook. I thought him being 12 years younger than me, he would live for at least 5 years and they would want the house for his care. Although Ed had become abusive, I still cared about his welfare.
Right away APS took over and in 2021, Keith along with help from the APS assigned guardian, Janette Goodwin, and court assigned lawyer, Gayle Young, made a new will, to cut me out of the estate, unbeknownst to me. This lawyer made up the will for him and the guardian witnessed it so obviously they were partners in this. I didn’t find all this out until after Ed died.
Ed died quickly for them. During that time I had found him passed out unconscious from alcohol and house filthy under their care and reported it to Lakewood police, getting me in trouble. The property was not cared for. They took his gun collection and cash from his safes and are now trying to deny this as part of the estate. They also got a reverse mortgage in his name only without me knowing about it which took $80,000 from our property. They kept all his ssi which was about 1,400/month, sold his ammo and only would take him less than once a week to the grocery, limiting the amount he could spend to $200. This forced him to quit smoking which was the only pleasure he had left. He begged me to find someone to help him get out of being a ward of the state. My hands were tied. They tried to criminally indite me. I fought back with a lawyer that ended up giving my money back as thankfully, the DA wouldn’t prosecute.
Detective Monn of Lakewood police did a complete investigation of me, including IRS and all my checkbooks and credit cards exposed, which Virginia Frazer-Able accidentally attached to her court document trying to make me look bad. But what it actually did, was uncover some of her lies. I got a nice lawyer to defend me named Jasen (sawyer law firm) who stood between me and the Lakewood court system until the DA would not prosecute me for guns Keith and the guardian had taken. That is how I found out that Virginia had opened the safe for them. That fine lawyer returned most of my money. Wish I could find a lawyer to handle this case. He doesn’t handle these kinds of cases.
From the beginning they lied to Ed, trying to turn him against me, telling him that I took his guns and made him think I was doing things against him. He believed Keith but his memory was so bad and he couldn’t make new memories after that psychotic episode so when I would see him he would still be nice to me. Every time I saw Ed his memory was getting worse and worse but he knew he was being controlled by them and he couldn’t help himself or find anyone to help him.
I saw him Christmas 2022 to give him a gift. His teeth were falling out due to malnutrition and then suddenly he died in January. They never once during that time took him to the doctor. I wonder if someone poisoned him as they immediately cremated him and did not honor his wishes to be buried in Michigan. They hid that he had died from me until I found out a month after. By that time, they were already trying to get the property in probate.
All these people tried to keep his death secret from me to use Keith’s will to get the property in probate but I found out and hired attorney Tom Ripp to defend me. This was not a good choice as he was communicating with Virginia A. Frazer-Abel the APS Conservator who had already attached herself to the property. I paid this lawyer Tom Ripp $8,000 and then he withdrew all the paperwork that I had filed without telling me and disappeared for 2 months. He was complicit. I had not heard from him since April 2023 and the judge did not rule for him to withdraw until July 12th. It is very difficult to fight a case if you can’t get to the paperwork or get rid of a bad lawyer.
Virginia A. Frazer-Able is now trying to steal the house for herself as she made herself Ed’s Personal Representative with the courts approval. Judge Todd Vriesman signed off on that. He probably did not check on her. I think she could be in trouble from making that reverse mortgage in Ed’s name alone and that is why she is fighting me so hard. She is trying to hid the fact that she has all his money with the estate, and is personally now trying to prove that the estate is only the property when there is money from the mortgage, from the guns and ammo she sold, from her keeping his SSI.
I am now representing myself and have learned a lot. Virginia hired two lawyers to represent her named Sandra M Sigler, $44522 Kayla R. Nelson, #46242 and they are trying to ask the judge for a quick sale on the property which is supposed to go into foreclosure in September. I have filed more paperwork trying to stop them. I just hope the Judge can see the truth.
